Central America Fishing Liability Waiver

In exchange for participation in the Fishing Vacation organized by Central America Fishing, I agree for myself and (if applicable) for the members of my family, to the following:

1. Assumption of Risk

I, the undersigned, understand and acknowledge that participating in a fishing vacation organized by Central America Fishing involves inherent risks and dangers, including but not limited to: - Slippery or unstable surfaces on the boat - Handling sharp fishing gear, hooks, and equipment - Exposure to sun, heat, or changing weather - Risks associated with marine wildlife - Sea sickness, physical exertion, or fatigue - The risk of drowning or falling overboard - Unpredictable sea conditions. I voluntarily choose to participate in these activities and expressly assume all risks, whether known or unknown, that may arise from my participation.

2. Release and Waiver of Liability

In consideration for being allowed to participate in a fishing vacation organized by Central America Fishing, I hereby fully waive, release, and discharge Latin American Vacations LLC, doing business as Central America Fishing, its owners, agents, employees, affiliates, and vessel operators (collectively, the “Released Parties”) from any and all liability, claims, demands, actions, or causes of action arising from: - Personal injury or death - Property damage or loss - Any other harm or incident that may occur on or off the boat. This release applies regardless of whether such injury or damage is caused by negligence, including the negligence of any of the Released Parties.
I understand that Central America Fishing is acting as an outfitter and does not own or operate the fishing boats, transfers, or accommodations used in their packages

3. Medical Condition and Responsibility

I certify that I am physically fit to participate in these activities and that I have no known medical conditions that would be aggravated by participation. I further understand that: -Central America Fishing does not carry medical insurance for participants. I am solely responsible for any medical expenses that may arise from injuries sustained during this vacation. I am aware that I can purchase travel medical insurance such as Travel Guard, Global Rescue, or Travelex, and it is my responsibility to do so.

4. Indemnification

I agree to indemnify, defend, and hold harmless Central America Fishing and the Released Parties from any and all liabilities, claims, losses, and expenses (including attorney’s fees) arising out of or related to my participation in the fishing charter, tours, and transfers booked by Central America Fishing.

5. Consent to Emergency Medical Treatment

I authorize Central America Fishing and its representatives to obtain emergency medical care if deemed necessary, and I accept full responsibility for any associated costs.

6. Governing Law and Jurisdiction

This agreement shall be governed by and construed in accordance with the laws of the State of Wisconsin, United States of America.

7. Severability

If any provision of this waiver is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

I HAVE READ THIS LIABILITY WAIVER AND I FULLY UNDERSTAND ITS TERMS AND SIGN IT FREELY AND VOLUNTARILY. I FURTHER UNDERSTAND THAT BY SIGNING THIS RELEASE I VOLUNTARILY SURRENDER CERTAIN LEGAL RIGHTS.
